Canucks Chuck Hate Music

Jamaican reggae and dancehall artists Sizzla (left) and Elephant Man (right) have been given the boot by at least one Toronto venue, after Canadian advocacy groups cited the pair for anti-gay slurs. Shows for Sizzla, who was scheduled to perform at Toronto's Kool Haus last Friday, and Elephant Man, who had an October 6 concert scheduled, were both canceled.

A coalition of around 20 organizations called Stop Murder Music Canada called for the artists to be banned from the country. "They shouldn't have been allowed to get visas to perform in the country. It's not about censorship or artistic freedom. That stops when hate propaganda is involved," coalition founder Akim Larcher told the Toronto Star.

This isn't the first time Elephant Man has run into trouble. In 2004, he was kicked off the British Mobo Awards for refusing to alter his homophobic lyrics.

20. What is a hate crime?

The Criminal Code of Canada says a hate crime is committed to intimidate, harm or terrify not only a person, but an entire group of people to which the victim belongs. The victims are targeted for who they are, not because of anything they have done.

Hate crimes involve intimidation, harassment, physical force or threat of physical force against a person, a family or a property.

Sections 318 and 319 of the Criminal Code of Canada address hate crimes.

Under Section 318, it is a criminal act to "advocate or promote genocide" - to call for, support, encourage or argue for the killing of members of a group based on colour, race, religion or ethnic origin. As of April 29, 2004, when Bill C-250, put forward by NDP MP Svend Robinson, was given royal assent, "sexual orientation" was added to that list.

Section 319 deals with publicly stirring up or inciting hatred against an identifiable group based on colour, race, religion, ethnic origin or sexual orientation. It is illegal to communicate hatred in a public place by telephone, broadcast or through other audio or visual means. The same section protects people from being charged with a hate crime if their statements are truthful or the expression of a religious opinion.

The law (subparagraph 718.2(a)(i), to be specific) encourages judges to consider in sentencing whether the crime was motivated by hate of: the victim's race, national or ethnic origin, language, colour, religion, sex, age, mental or physical disability, sexual orientation or any other similar factor.

22. #13 - Maybe you should research something you have little knowledge of before you make a comment.

For your information Canada has plenty of "gun rights". Many people own guns we just have tight restrictions on them so they do not fall into the wrong hands. If you really wanted one you wouldn't mind going through the paperwork to get one. Also, Canada doesn't have amendments. We have something called the Charter of Rights and Freedoms. Free speech is the second thing listed on it. Though we do have freedom of speech, hate propaganda is an entirely different issue. Someone can say they don't like gays but they have no right to make money off song lyrics that endorse violence against gay people - that is a violation of their right to be free of persecution.

23. Um... but they do nothing about the anti-women lyrics? WHAT THE HELL? There is WAY more of that in rap than ANTYHING ELSE. What happened to OUR rights? OUR protection from the media?

24. In response to the assertion that Canada has no protection for Freedom of Speech, that is incorrect. Freedom of Speech is protected by the Charter of Rights and Freedom. You are right that there is no Freedom to Protect The Right to Bear Arms (thank god by the way). Canada has an unique ability to protect the right to speech while at the same time criminalizing hate. I am proud to be a Canadian!!

30. I'm a New Englander forever, but I admire Canada for many reasons:
Low crime rate
Universal health care
Unwillingness to engage a sovereign nation in a war based on lies
Great, kind people
Montreal - great place for a long weekend getaway. The subways are immaculate, and one feels safe walking about the city at night
Beautiful Nova Scotia and Prince Edward Island

Canadians certainly have the right to free speech, but it is perfectly within the rights of the citizens and the government to have a zero-tolerance policy for those advocating hate crimes against any group.

Love America, but love Canada, Australia and New Zealand also.
Peace, Annabeth
